Will Notes | In the name of God Amen I Joseph Walker of Middle River Upper Hundred in Baltimore County and State of Maryland being sick of body but of sound mind and memory do make and ordain this my last will and testament in manner and form as followeth. That is I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the earth to be decently interred at the discretion of my executors and touching such worldly effects which it hath pleased God to bless me with I will and bequeath in the following manner and form. Imprimus I bequeath unto my loving wife Catherine Walker 16 pounds currenct money of Maryland yearly and every year during her natural life also one house where she now dwell and the garden adjoining thereto, one cow, one heffer such as she may choose out of my cattle to be kept and fed for her, for and during her natural life as aforesaid, also as much of the household furniture of every kind and denomination as she may choose to keep for and during her natural life. Item I will and bequeath to my Grandson Mathew Walker one shilling sterling Item I will and bequeath my personal property of every kind (my lands and what is already bequeathed excepted) to be equaly divided amongst my four children viz my son Daniel Walker, my son Christopher Walker my son George Walker and my daughter Mary Walker alias Curtis. Item I will and bequeath unto my two sons Daniel Walker & Christopher Walker all my lands or landed property of whatever kind or denomination to be equally divided between them for and during the natural life of my wife Catherine Walker, they the said Daniel and Christopher Walker paying yearly and every year unto my loving wife Catherine Walker each of them one half of the legacy already bequeathed her and fulfilling unto her all other prerequisites as above recited for and during her natural life. Item I will and bequeath (after the decease of my loving wife Catherine Walker) unto my son Christopher Walker all that tract or parcel of land called Mashes Mistake containing about Eighty one acres also one half of the tract of land whereon I now dwell to him the said Christopher Walker his heirs or assigns forever. Item after the decease of my loving wife Catherine I will and bequeath the other half of the tract of land wheron I now dwell unto my son Daniel Walker his heirs or assigns forever and further I will and ordain that my two sons Daniel and Christopher shall immediately after my decease take possession of the lands as above recited only that the crop which may then be on the Ground shall be considered as pesonal property and lastly I do make Constitute and appoint my son Daniel sole Executor to this my last will and Testament In whereof I have hereunto set my hand & seal this 1st day of December in the year of our Lord one Thousand seven hundred and ninety one his Joseph X Walker seal mark Signed sealed published & pronounced by the said Joseph Walker as his late Will and Testament in the presence of us who in his presence and the presence of each other have hereunto subscribed our names Benjamin Merryman Baltimore County to wit on the 20th day of May Jesse Mathews 1800 came Benjamin Merryman & John Foster sub- John Foster scribing Evidence to the aforegoing last will & Testament of Joseph Walker late of said County deceased and made oath & that they did see the Testator sign and Seal this will that they heard him publish pronounce and declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of sound disposing mind memory and understanding and that they subscribed their names as witnesses to this will in his presence at his request & in the presence of each other & of Jesse Mathews the other witness sworn before me register of wills for BC of MD Wm Buchanan | |
