- Last Will and Testament of Amos Hilton.
In the name of God, Amen. Amos Hilton of Ohio in the Township and County of Yarmouth, Province of Nova Scotia, being of sound mind and memory but mindful of the uncertainty of these (unk) make this my last will and testament humbly commending my soul to the tender mercies of our blessed redeemer and my body to his Mother Earth in full hope of a glorious reserrection. First, I make such a disposal of my property as follows viz. After paying my funeral expenses, I give devise and bequeath to Caroline my beloved wife all the money that may be on hand at the time of any deceased. I also give devise and bequeath to Caroline my beloved wife all the land of the farm on which I now reside with house, barn, outhouses, stock of all kinds on the Farm at the time of my deceased with all farming utensils and all the (unk) paraphernalia furniture apparel and all other articles in her (unk), and all the house contains that is to say beds, bedding furniture....also one pew in the Ohio Baptist Meeting House, , and one piece of ground in Hebron Burying Ground, and also one piece in Ohio Burying Ground. to have all the above named property so long as she doth live...But at the deceased of Caroline my beloved wife, I give devise and bequeath to my youngest son Ebenizer Hilton his heirs and assigns the Farm as I have willed to his mother her lifetime and on which I now reside with House, Barn, outhouses, and all livestock and all farming utensils on the Farm at the deceased of Caroline my beloved wife. The said Ebenizer hilton to pay each of my children living at the deceased of Caroline my beloved wife the sum of ten dollars a piece. Namely, to my sons Amos Caleb Hiltom, Jacob Hilton, Jeremiah Hilton. To my daughters Rebecca Allen, Lucy A Killam, Margaret Winters, Elizabeth (Unk), Lydia Eldridge, Hannah Wyman, and Bertie Hilton.
I also give and bequeath and all claims of my estate to be relinquished against my son Amos Caleb Hilton at the deceased of my beloved wife and all the amount that she is indebted to me at this present time I give and bequeath to him except the interest at (unk) percent on the amount of this indebtedness while Caroline my beloved wife doth live, said interest to be paid to her.
But having in view the last named gift and bequeath to my son Amos Caleb Hilton the above named Ten dollars is not to be paid the said Amos C. Hilton by the said Ebenizer Hilton.
I give and bequeath each on my children, namely to Jacob Hilton, to Jeremiah A. Hilton, to Rebecca Allen, to Lucy A. Killam, to Margaret Winters, to Elizabeth Tennell, to Lydia Eldridge, to Hannah Wyman, and Bertie Hilton the sum of ten dollars a peice to be paid them by said Ebenzer Hilton at the decease of my beloved wife and when coming in possesion of the above name dproperty willed to them.
Lastly I hereby appoint my beloved wife Caroline Hilton and Jacob Scott Hilton my son to executors of this my last will and testament and I direct them to settle my estate.
In witness whereof I herein to set my hand and affect my seal at Ohio Yarmouth this twenty sixth day of February, A.D. 1881. signed, sealed, published and delivered by said Amos Hilton in the presence of who have here unto or hands affixed and witness...AMOS HILTON. (Witnesses are unreadable but believe one of the names to be Comfort W. unk)
Registered the fifteenth day of March A.D. 1881 on the oath of Comfort W. (unk) of Ohio in the County of Yarmouth, farmer one of the subscribing witnesses there to, there being no material alteration erasure (unk) in the original except that in the original will immediately before the insertion of the "(unk)" clause a blank space of nine and one half lines appears unappropriated.
