- JAMES, b. about 1675; m. Mary He lived in Eliot and like his brother John was a deacon. Thomas Spinney called him cousin in 1715, and John Dennett called him kinsman in 1717.
James Fernald of Kittery, yeoman, made his will April 2, 1739, and it was proved Jan. 19, 1741. To his wife Mary he left one-half of his houses and lands in Kittery during her life, and after her death they were to go to his son James. To his wife, his other lands not in Kittery, on her death to be divided among his daughters, the eldest, Elizabeth Fogg, to have a share and a half and the rest to be treated equally. To his wife, all of his household goods, debts and movable goods, to dispose of as she sees fit among his children, but if she marries again she is to enjoy but one-third of his estate for life. To his daughter Elizabeth Fogg, 5s. To his daughter Mary Adams, £3. To his daughter Joanna Rogers, 5s. To his daughter Anne Fernald, £8. To his daughters Marget Fernald, Dorcas Fernald and Unice Fernald, £50 each. To his son James, one-half of the houses and lands in Kittery, and, after his mother's death, the whole of the real estate in Kittery. Executrix: his wife Mary. Witnesses: Lydia Fernald, Benjamin Fernald, John Godsoe. An inventory of £4160: 0: 5, old tenor, was entered by Thomas Cutt, Benjamin Parker, jun., and John Godsoe on June 22, 1742.
